# UK audit regulator makes fresh inquiries into Man City accounting after Premier League verdict

**The UK’s accounting regulator is making preliminary inquiries into issues surrounding City’s accounts following the verdict in the club’s long-running Premier League financial case.**

The Financial Reporting Council has confirmed that it took over “regulatory consideration” of the matter from the Institute of Chartered Accountants in England and Wales on September 30. No formal FRC investigation has been opened at this stage.

The development follows findings made by the independent commission considering [Manchester City’s](https://readmancity.com/) alleged breaches of Premier League financial regulations between 2009/10 and 2017/18. City are appealing the verdict and maintain that the commission’s decision contains material errors of law, principle and fact.

## FRC considers issues surrounding Man City accounts

According to [BBC News](https://www.bbc.co.uk/news/articles/cm93z1xlgqxqo), the FRC confirmed its involvement in a letter to the House of Commons Business and Trade Committee. The regulator has greater resources and enforcement powers than the professional accountancy body which had previously been considering the matter.

Its remit could include the conduct of BDO, City’s auditor, and whether relevant professional and auditing standards were followed. The independent Premier League commission found that City’s auditors were unaware of arrangements which formed part of the case, while BDO declined to comment to the BBC.

## Separate from Man City appeal

The FRC’s inquiries are separate from City’s appeal against the Premier League commission’s findings and do not represent a further verdict against the club. City have consistently denied wrongdoing and are challenging the commission’s decision, which they have described as unsafe.

The regulatory process concerning accountants and auditors is distinct from the Premier League proceedings and has its own threshold before a formal investigation can begin. The FRC can investigate professional accountants and accountancy firms in cases raising important issues of public interest where there are reasonable grounds to suspect misconduct, with its disciplinary process allowing sanctions against individuals or firms within its jurisdiction if misconduct is ultimately established.

## Limits of FRC powers raised

Liam Byrne, chair of the Business and Trade Committee, has also raised questions about the limits of the regulator’s powers, including its ability to obtain evidence from a football club or pursue directors who do not fall within professional accountancy rules.

The latest development does not change the status of City’s appeal or amount to a new finding against the club. It does, however, raise the prospect of separate regulatory scrutiny of the professional accounting and auditing issues arising from the Premier League case, should the FRC decide there are grounds to move beyond its preliminary inquiries.
